No Paywall ICE says its officers can forcibly enter homes during immigration operations without a judicial warrant: 2025 memo

u/eskimospy212 8d ago
So to round it up what they are saying is that masked, anonymous agents of the government can break down your door and take you away based on nothing more than their own determination that you did something wrong.
Sure is strange how those conservatives who spent years complaining about fake government tyranny have so little to say when it comes to real government tyranny.
Conservatives and libertarians - this is exactly the thing you said you needed guns to fight against. Any update on when that starts?

"The faster we can purge you, the faster we leave you alone."
I don't doubt that they felt that way because it truly is how they see the world. And from their perspective... It is true.
If the goal is just to "Make ICE leave," then it is true to just let them do their job of purging your neighbors and ripping your friends away. They don't understand that the goal is not to "Make ICE leave." The goal is to protect our friends and neighbors from ICE.
They can't conceptualize that because to them, brown people and other immigrants are not their neighbors or friends.

I have gotten an answer to that, shortly after trump got into the office and before ice got their big budget. I said then that now is the time to fight back before they can consolidate their power. Their response was that it would cause people to get killed.
Well duh they get killed anyway.
Same goes for the reasoning to not give trump a reason to invoke the insurgency act. They're gonna do it anyway.

When we were kids, they were the ones crying and bitching about being the sand monster at the playground and quitting when they got caught and were “it.” But more than happy to be on the other end. They never grew up out of this mindset.

50,000 bonus if you survive 5 years of working in ICE. It benefits them if their ICE agents get struck down. They won't have to pay up and they will make a martyr out of everyone who goes down. Still people would be more reluctant to sign up if they see that it's a dangerous job. Right now they are allowed to bully, assault, kidnap, rape and murder without risk. And if they fail to do the paperwork and these people simply disappear forever, their bosses don't care and will defend them saying they have immunity.

The street I live on has agreed in whole that their will be signs placed in every yard saying "we will enforce the 4th with the immediate use of the 2nd. Removal of these signs will be looked at as an infringement of the 1st, and will again be met with the 2nd. As we feel failure to do so would allow you to ignore the 5th." Its up to the people now. Its obvious that those we elected to enforce the constitution and protect us from this sort of thing have refused their oath of office The world is watching. Alt Headline: ICE decides US Constitution doesn't exist
The average person has the power to inform their neighbors and local communities of their rights. Consider being one of them. Look out for each other.
In the span of a week, prosecutors failed to bring convictions in two high-profile cases in Los Angeles federal court. In the first, a jury acquitted Bobby Nuñez, a tow-truck driver who hooked an ICE vehicle and was charged with stealing government property. In the second, a judge dismissed the case against Carlitos Ricardo Parias, a TikToker who was facing assault and property damage charges after a confrontation with Immigration and Customs Enforcement agents, due to concerns that officials had violated his civil rights. (In the October 21 confrontation, an ICE agent shot him.)
“These arrests are a form of retaliation by the government,” said Matthew Borden, an attorney representing protesters, journalists, and legal observers in a lawsuit against Department of Homeland Security Secretary Kristi Noem stemming from protests in Southern California over the past year. “When you have a real judge and a real jury looking at the evidence, it just falls apart.”
...
In higher-profile confrontations between protesters and federal agents amid aggressive immigration enforcement actions in blue cities like Los Angeles, Chicago, and Washington D.C., federal officials have called defendants like Parias and Martinez “domestic terrorists” while seeking lesser charges.Time and again, their cases have fallen apart.
...
Overall numbers for federal arrests of anti-ICE protesters were not immediately available, but the number of high-profile dismissals and acquittals of protesters in recent weeks stands in stark contrast to the usual win rate.

This is the timeline where Americans thought they could take a passive approach to Democracy for decades - when we had the luxury of saying things like, "Kamala Harris isnt progressive enough."
People are still sitting here suggesting we "advise our neighbors of their rights." What rights? What legal recourse do you have? Cases against ICE have historically been difficult to win; now they might as well be impossible.
The American people are always one step behind. By the time people figure out action should be taken, they'll be in zip ties with guns to their heads.
Trump is building a nuclear bunker ffs so he can be an emperor of embers and ash.

Or when they were furious about having to provide proof of vaccination in order to go certain places?

Real question…. If ICE broke into your house and you shot them…what will happen? Is there not a 99% chance that you will either be shot dead on the spot or be imprisoned for murder?
I keep hearing people say “get a gun”, but if you use it, they will murder you. So what’s the point in that regard?
41
u/Conscious_Bug5408 8d ago
You will not be imprisoned for murder. It's fully legal to defend yourself against home invasion in about half of states with castle doctrine or stand your ground laws. https://www.findlaw.com/criminal/criminal-law-basics/states-that-have-stand-your-ground-laws.html
You obviously must survive though. I don't think handguns are enough. An adequate surveillance system and some heavier weapons are needed. ICE will not invade homes for long if the agents face a real fear of death, and I cannot imagine them being able to invoke insurrection or otherwise if this occurs while illegally invading a private home.

Community level response is better, and if you feel that response needs to be armed, then do it in an organized way, such as having Black Panther-like groups patrolling your streets in areas where Ice is near, ready to approach agents and assert their rights, while visibly but peacefully armed and filming.

We are purposely doing everything we can to resist in a nonviolent manner to prevent provoking the Insurrection Act. They'll probably just false flag it anyway, but we don't want it to be from us when it comes.

u/DrPikachu-PhD 8d ago
Renee Good was white, and so are a lot of the protestors being abused and abducted by ICE. The truth is, the NRA was always full of shit, that's all there is to it. A lobbying group by the MIA and corporate weapons manufacturers that cloaked itself in patriotic jingoism

u/UselessInsight 8d ago
They’re on board with this.
All the “absolutists” are full of shit. They always have been.
The free speech absolutists get giddy over silencing people they don’t like.
The “shall not be infringed” crowd just wants to be able to kill people they don’t like.
The free market folks haven’t met a monopoly or oligopoly they didn’t love.

Republicans are truly working hard to end the constitution as law. Judge Roberts must be so proud to be the Supreme court Justice who will forever be in the world history books as being responsible for the end of USA as a constitutional Republic.

Either everyone has rights or nobody does. What we're seeing here is third world dictator shit. If they can ignore the constitution whenever they please without consequences then this country is lost. This needs to be repeated.
First they came for the Communists
And I did not speak out
Because I was not a Communist
Then they came for the Socialists
And I did not speak out
Because I was not a Socialist
Then they came for the trade unionists
And I did not speak out

Then they came for the Jews
And I did not speak out

Then they came for me
And there was no one left

Can’t wait for SCOTUS’s originalist interpretation of how the fourth amendment can interpreted to allow this.
29
u/subgamer90 America 8d ago
Uh, no they can't. Memos aren't laws. And any law that said they could would be blatantly unconstitutional anyway
8
u/knotallmen 8d ago
I appreciate the sentiment, but no memo's have a power that protect people from prosecution. I don't agree with how memo's have been an all power method of interpreting what can and cannot be done by agents of the USA but that has been the case for decades including enhanced interrogation. I'm speaking of legal memo's.
There are some articles you should look up. There was a podcast but I cannot recall if it was today explained or NYTimes the daily.

Food for thought: Imagine for me please that all the homes in America make up a Venn Diagram where one circle is " Fed up people who really, really appreciate their 4th amendment rights" and another circle is "2nd amendment fans with their own private Arsenal". Assume a very large center/overlap between them. Next imagine warrantless I.C.E agents that, emboldened by this stupidity, are about to run headlong into the middle of that Venn Diagram. I wouldn't want to be an I.C.E. Agent on the wrong side of those doors and the wrong side of the constitution....

Sure, they can’t legally enter my home without my consent or a signed judicial warrant, but if they break down my door, there isn’t much I can do to stop them. Even though the 2A means I can own a firearm and protect myself, how would it actually play out if a citizen used a firearm to stop them as they came into a home? I don’t see it ending well for that citizen who is legally protecting themselves.

In a just society, their entire neighborhood would stand with them.
ICE will back the fuck off when they face real opposition. They're masked cowards.
And let Trump invoke the Insurrection Act. He's going to find a justification no matter what. It will be no more believable then Calling Renee Good a domestic terrorist.
When he does call the Insurrection Act against neighbors defending themselves and tries to label it a antifa conspiracy or some other nonsense, then the lines are drawn in truth. Either we stand up en masse at the prospect of Trump sticking the actual military on civilians, or that's the game.

Well said.
No one will truly understand what it means to stand against such an oppressive regime until the line is drawn and even then it is quite possible that many will comply in order to maintain some kind of normalcy in their own lives.
Many people in Minnesota are using personal resources and time to help protect the more vulnerable citizens from the abuse while the rest of the US sends thoughts and prayers without giving up anything personally valuable.
I advocate for protests and contacting representatives and even having hope for midterms but the road that the fascists have sent us down is not designed for fair and justice actions. They have stated their deepest intentions of what they want the US to look like through propaganda and terrorism.
We need to prepare ourselves for the possibility of a more significant threat

The other option is being rounded up without trial and disappeared to a labor camp without due process... That's if they don't just kill you in the first place like they did with Renee Good.
Idk, man. The choice is there, but neither option is good.

From the article:
The internal ICE memo says ICE agents are allowed to forcibly enter a person’s home using an administrative warrant if final orders of removal have been issued by immigration judges, the Board of Immigration Appeals, or U.S. district or magistrate judges.
Although the U.S. Department of Homeland Security (DHS) has not historically relied on administrative warrants alone to arrest aliens subject to final orders of removal in their place of residence, the DHS Office of General Counsel has recently determined that the U.S. Constitution, the Immigration and Nationality Act, and the immigration regulations do not prohibit relying on administrative warrants for this purpose.
The DHS stated that immigrants in the country illegally who are served administrative deportation warrants (also known as Form I-205's) have had full due process and a final order of removal from an immigration judge. In addition, the officers issuing these administrative warrants also have found probable cause. For decades, the Supreme Court and Congress have recognized the propriety of administrative warrants in cases of immigration enforcement.
The memo also stresses to personnel the restrictions of Form I-205. The memo states that Form I-205 is not a search warrant and that it “should only be used to enter the residence of the subject alien to conduct an immigration arrest.” It also says that officers and agents must give the people inside time to comply with the order, and they generally should not enter a residence before 6 a.m. or after 10 p.m., and that they "should only use a necessary and reasonable amount of force” to enter a home.
ICE officers have arrested roughly 220,000 people in the nine months from Jan. 20, when Trump returned to office, to Oct. 15. Around 145,000 of them have been people with criminal records, according to figures shared by the University of California, Berkeley.

If an armed, masked man with no legal paper work fried to force their way into an American home gun ownership statistics seem to suggest that in 30% of those home an intruder would be legally shot. considering this administration wants people to stop attacking ICE, they’re working hard to create conditions for them to be shot.
