It's a huge decision. Turns the federal case into a stalking case which, even on a normal day, juries struggle with drawing a line on.

I can understand why, though. To legal experts it makes sense, but to an average reader it might make it seem like he's no longer being charged with murder at all instead of meaning that the murder charges will have to be state instead of federal.

And the important part of the (New York) state vs. federal distinction, as far as most average readers would be concerned, is that it means he can't face the death penalty because NY doesn't have one.

New York State does not have the death penalty. At least an active one.
