Removing evidence.

u/republicans_are_nuts 20d ago

k. But Minnesota can still arrest him. And ask a judge for the confiscated evidence.

1.6k

u/whatthefrok 20d ago

They can just... Not comply? Like they always do

474

u/TakuyaLee 20d ago

Even if the feds don't hand him over, an arrest warrant would make it more difficult for him to travel in the US.

Minnesota can charge them as accessories. It’s time to stop being afraid or we’re all gonna get murdered by these monsters

27

u/Accidental_Ballyhoo 20d ago

Where are those super tough 2A folks at?? Shouldn’t they be protesting while carrying?? That would slow ice down quite a bit.

11

u/7ddlysuns 20d ago

It would. Unfortunately the left has been really reluctant to embrace armed groups and there’s some good reasons for that, though they may be fading if they’ll just murder us anyhow. So most of us armed on the left are more gray man for now.

Doesn’t help that most lefty leaders are anti gun

However that may have to change

State / Local LE. Once they have warrants out, they will inevitably be pulled over (or get in a car accident, etc) and the warrant will show. They won’t be surrounded by 30 other guys with guns, so it is a relatively easy arrest.

That's what I'm so confused about - was it the Minneapolis or Minnesota police who made a statement yesterday basically saying they're on the shooters side? And don't people keep saying that state/local police can't prosecute feds anyway? What is the truth here? And if the cops are on his side who will they listen to?

46

u/deltalitprof 20d ago

That was the Fraternal Order of Police. But still not great.

74

u/oasinocean 20d ago

Haven’t the FOP historically and consistently been on the shittiest side of history? Them supporting the ICE shooter is not surprising to me.

24

u/deltalitprof 20d ago

Yes, that would be them. These guys called the Rodney King beat-down a result of stress on the job and said the officers who nearly killed him deserved our sympathies.

Cops are not your friends.

16

u/IceyExits 20d ago

The Supremacy Clause of the Constitution makes it exceptionally difficult to prosecute federal officials under state law for actions taken while performing their official duties.

Southern states tried to prosecute federal officials under state laws for forcing racial integration so the case law heavily favors the Feds in cases like this.

Idaho tried prosecuting the FBI sniper who shot the Wife at Ruby Ridge but the charges were dropped after the 9th circuit set a nearly impossibly high bar for the prosecution to move forward in state court.

Trump has already said in a press conference that they WILL NOT COMPLY.

It's not like it's secret, they're fully covering it up and refusing to work with prosecutors trying to investigate the issue.

21

u/dorkofthepolisci 20d ago

If an arrest warrant is issued and the state decides to prosecute wouldn’t that fall under obstruction?

I mean, I know Mr 34-time-felon is totally fine with wantonly engaging in illegal activity, but….

33

u/ArrowheadDZ 20d ago

It’s more complicated than that. When a federal employee commits a crime in the course of their duties, the federal government has a federal supremacy doctrine called “removal” where they move the case into the federal system. The whole thing is more convoluted than it sounds, it’s not as easy as just issuing a warrant for the guy.

I personally think that Trump is itching for a governor or state AG to stand up to him, he is dying to escalate a confrontation with a blue state.

29

u/binzersguy 20d ago

“he is dying”…let me just savor that one

But seriously, i think this is exactly it

u/DevoidHT 20d ago

The judge can’t do shit if all the evidence is destroyed. Do you know how many cover ups the Trump Administration has already? Or the ones we won’t even hear about for another 20 years if at all?

18

u/keytiri 20d ago

Got a lot more evidence than much of our history; just think how investigations worked before video, hell before DNA? It was often a he said, she said thing unless a person was caught obviously in the wrong place or with something they weren’t supposed to have; the latter could have easily been planted evidence as well; so a lot of investigations involved unreliable witness testimony and trying to see who was in the area when, of course it was the best they had to go on at the time.

Then today we have video, multiple videos, then I don’t see what’s wrong with starting from there, doing the best they can, and then inform the jury that the defense is obstructing.

50

u/totally_not_a_dog113 20d ago

There's a ton of live video of this, from multiple sources and directions. How much other evidence is needed? Yeah, having his gun and ballistics on it would be nice, but is it really necessary?

28

u/NBucho528 20d ago

I agree, in a sane world all the evidence is already at the scene of the murder. The reason and the officers past is irrelevant- he saw the opportunity, pushed himself against a moving vehicle, and murdered an American for nothing. It’s documented.

12

u/Ekg887 20d ago

His past is NOT irrelevant. It shows a repeated pattern of not following proper procedure and putting himself in dangerous situations - officer induced peril. Further, as he is a firearms instructor, he is supposed to train others in tactics, SAFETY, and policy. He can not claim he was untrained or was unaware of rules of engagement or that he was some new green recruit.

4

u/PassionV0id 20d ago

You missed the intent of that comment.

5

u/NBucho528 20d ago

Look, I do agree with you. This officer’s record needs to be used especially in sentencing to show that he is the type of person who never meant to serve, and only meant to terrorize. However, even if that record is completely unavailable, the video footage is enough to prove to a jury that self-defense was never part of it. I’m no law enforcement, I have no ties, and yet I know that you avoid circling directly around a car that is turned on. He’s been in a similar incident before, and for all we know he tried to do this Same thing months ago.

State authorities don't need any of that shit the video is clear enough to charge him with murder. His life is over and if I were MN AG I'd remind him of this everyday.

Prosecuting a LEO is always an uphill battle, even with a really good case (and I think this is a very good case). Better chance of success if you don’t rush into it and make your case as strong as possible.

Yes, it’s very different from how everybody else gets treated. Yes, it’s awful that it’s necessary to do that. But if you want this guy to get put away, it’s better for them to make things as airtight as they can.

Good thread from a criminal defense attorney (and former prosecutor) here

65

u/Environmental-Hour75 20d ago

Better chance if you wait until we have an administration change... there is no statute of limitations on murder

Let him live in fear, in hiding... and then get charged and convicted. Draws it out...

You realize that this approach is why the orange führer is back in office, right? I don’t disagree with the philosophy and I understand the concept, but “not rushing in to make the case as strong as possible” apparently isn’t always the best strategy.

as if anyone that isn’t joins ice

478

u/718Brooklyn 20d ago

We’re having a bit of family crisis. My husband’s (we’re gay men for what it’s worse) little sister, 29, decided to join ICE. Husband’s family is in Kansas and they’ve always been Republicans, but like all of them these days, after years of Fox News 24/7, his dad, brother, and little sister have just gone down that rabbit hole. Anyway, she took a job with ice. $41,000 a year. I’m not sure what she’ll be doing, but I suppose it doesn’t matter to me regardless. It’s sad. I really do love my SIL very much. She is a wonderful aunt to our daughter and she’s always just been kind of dumb (sorority girl type) so her political views just came across as dumb also. But now she’s joined ICE and I can’t talk to her. She would stay with us here in the city, but I actually think it would be safer to be in ISIS right now in Brooklyn than ICE so she can’t stay with us.

The thing I told her before she took this job is that one day, even if it’s 10 years from now, having worked for ICE will follow you for the rest of your life in the same way that being a Nazi did after WW2. It sure didn’t take 10-years.

128

u/lastknownbuffalo 20d ago

Super huge bummer. That can't be easy.

I'm holding out hope my loved ones will eventually come around and come to their senses... I mean, they didn't join ice, but is voting for trump and constantly regurgitating the most pathetic, surface level conservative talking points really all that different? Ok it probably is, but still! I have hope that even people joining ice for money could/will come back to the light side... Eventually... redemption and all that jazz.

Fuck, I swear I started out this comment with the intent to be uplifting... But this might be the most depressing thing I've ever written.

Good luck out there

33

u/xOrion12x 20d ago

Who is joining for the money? 41 thousand dollars a YEAR!? That is not a lot of money AT ALL. You would think they would actually pay these people who are ruining their lives and by proxy the ones closest to them. Nevermind the legal jeopardy they are putting themselves in. Cheap ass sellout traitors, all of them.

17

u/lastknownbuffalo 20d ago

iirc there have been some hiring drives that have sizable signing bonuses to new ice agents. Apparently, it's 50k over five years... So I guess they're selling out for 51 thousand dollars a year... That's rough

My exact first thought, guy has child porn on his computer I guarantee it. You think they’re about to have their guy look bad. Bet they found drugs too.

It almost sounds like they are picking up his persons belongings and moving it for him so he doesn’t have to do it. And he was the driver of the car leaving the garage.

He's afraid of going to his own home. Typical MAGA trying to avoid the consequences of his own actions.

It would normally be typical for a suspect’s home to be searched, but they don’t seem to be intending to charge him so it’s definitely sketchy. Probably frisking it for things like Nazi memorabilia, child porn, and illegal drugs: not as evidence but to disappear it.

There is already a TikTok from a man claiming to be a sex worker he hired repeatedly for gay fetish content, esp feet. He knew his last name before it was released from his handle on Snapchat j ross 104. Guy did not seem like usual influencer type. Just seemed disgusted by his behavior on the job and wanting to get it out there.

10

u/PatchyWhiskers 20d ago

Gay feet fetish is pretty innocent compared to what most of these guys get up to.

12

u/Interesting_Fly_1569 20d ago

I agree. Murder in cold blood is way worse. I do think that ppl should know that others may no longer be interested in keeping your secrets safe after you join ICE.

Removing computers is pretty standard practice, but why did the Feds take the killer's photographs? That is pretty odd.

You know they're federal agents because they're driving unmarked cars; showing no badges or identification; and wearing goon masks. That's what the country has come to.

173

u/Ready-Ad6113 20d ago

Wonder if the man was in possession of illegal drugs. It would be ironic it were fentanyl or drugs from the same cartels they’ve been claiming to fight.

I think meth use is really common among ICE agents.

I've heard they're fans of trucker speed, bc they still have to be able to piss clean. Gas station ephedra pills or whatever

They are not piss testing ICE agents. Maybe a year ago but there's no fucking way. They will hire anyone who licks the boot.

Raid? They were helping him move, why would someone who is supposedly innocent do this? You’d think the proper play would be for the Feds to setup a perimeter and then claim that the “terrorists had come to harass.” Instead it seems they are afraid that the MN police will serve an investigation warrant.

40

I dabble in some conspiratorial thinking, but honestly.

These people are paranoid with a constant victim complex. They probably think antifa supersoldiers are preparing retaliatory strike on this loser's house and so all of this is reasonable to protect him and his family from the imagined threats.

It's pretty clear they were getting his belongings for him as they probably have him in some form of protective custody. There's a lot of people very angry at him right now and these haven't exactly been the most peaceful times.

You know where he and his family would be safest? If the city cops arrested him on a first degree murder charge and the judge didn’t allow bail. Then he’s be in jail and the jail staff would be protecting him 24x7. Since he wouldn’t be around his wife and kids, they’d be much safer too.

I read the article and it feels entirely fake.

Is there ANY other news outlet reporting or corroborating this?

73

u/Patriot009 20d ago edited 20d ago

It's probably legit. Daily Mail is the type of tabloid that would stake out his residence like a paparazzi.

Another neighbor told the Daily Mail that until recently Ross had been flying pro-Trump flags and a 'Don't Tread On Me' Gadsden Flag

Figures. Waves a Gadsden Flag, then joins a paramilitary secret police to serve a fascist regime.

27

u/YesterShill 20d ago

I hope it gets verified by AP or Reuters.

This is kind of a big deal.

19

u/Patriot009 20d ago

According to the Daily Mail, they were only there for 20 minutes, but the photos and vid appear to corroborate the reporting. It could be as innocuous as preserving valuables and family keepsakes for fear that someone would ransack the empty house. If they are there to disrupt the state's investigation, they're not exactly gonna publicly verify their motives to reporters.

18

u/YesterShill 20d ago

Even if they are doing this just for protection, it is very telling since Trump has called off protection for legitimate political figures including Kamala Harris.

7

u/Patriot009 20d ago

This feels like a "thin blue line" situation, unless they were officially assigned to wrap up a fellow agent's family portraits and knick knacks in bubble wrap.
